MewTropics Terms of Use Agreement

1. General Provisions

1.1 Acceptance of Agreement: By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement. 1.2 Updates to Agreement: This Agreement may be updated from time to time. We will notify you of any material changes by posting the new version of the Agreement on our website.

2. Scope of Services

2.1 Description of Services: MewTropics offers a platform for users to learn and apply methods for improving posture and lifestyle through various exercises and educational content. 2.1.1 Educational Content: Includes but is not limited to articles, videos, infographics, and interactive media provided on our website or through other delivery methods. 2.1.2 Personalized Consultations: One-on-one sessions offered via online meetings, phone calls, or in-person, tailored to individual user needs. 2.1.3 Instructional Classes: Group sessions that may be conducted in virtual or physical classrooms, covering specific topics within our scope of expertise. 2.2 Limitations of Service: Our Services are not a substitute for professional medical advice, diagnosis, or treatment.

3. User Registration and Accounts

3.1 Account Creation: Users must register for an account to access certain Services, and in doing so, must provide truthful and accurate information. 3.1.1 Account Information: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. 3.1.2 Account Security: You agree to notify MewTropics immediately of any unauthorized use of your account or any other breach of security. 3.2 Termination of Account: MewTropics reserves the right to terminate or suspend your account if you provide false or misleading information or violate the terms of this Agreement.

4. Intellectual Property Rights

4.1 Ownership: The content provided through the Services is owned by MewTropics or its licensors and is protected by intellectual property laws. 4.1.1 Copyrighted Materials: All textual, visual, and audio content, as well as the overall design and appearance of the Services, fall under copyright protection. 4.1.2 Trademarks: Any logos, names, and other brand identifiers used in the Services are trademarks of MewTropics and may not be used without permission. 4.2 Use of Content: Users may not use, modify, distribute, or create derivative works based on the content provided through the Services without obtaining permission from MewTropics.

5. User Content

5.1 User Contributions: Users may submit content to the Services, such as comments, photos, or other materials. 5.1.1 User Responsibility: Users are solely responsible for their content, including its legality, reliability, and appropriateness. 5.1.2 Rights Granted to MewTropics: By posting content to the Services, you grant MewTropics a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Services. 5.2 Content Standards: User content must comply with all applicable laws and regulations and must not infringe the rights of any third party.

6. Payments and Billing

6.1 Fees for Services: All charges related to the Services will be stated clearly at the time of purchase. 6.1.1 Payment Method: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. 6.1.2 Recurring Charges: For subscription-based services, you will be billed in advance on a recurring and periodic basis (billing cycle), as agreed upon at the time of purchase. 6.2 Refund Policy: Refunds are handled on a case-by-case basis and are subject to the specific terms of each service offered.

7. Cancellation and Refund Policy

7.1 Cancellation by User: Users may cancel services according to the specific terms and conditions outlined for each service. 7.1.1 Notice of Cancellation: Users must provide clear and timely notification of cancellation (at most, 2 hours in advance for 1-on-1 consultations. as per the specified procedures. 7.1.2 Effect of Cancellation: Upon cancellation, users will cease to have access to the canceled services from the end of the billing period. 7.2 Refunds: Eligibility for refunds will be determined per MewTropics’ refund policies, considering factors such as service usage and time of cancellation.

8. Disclaimers

8.1 No Warranties Provided: The Services are provided on an "as is" and "as available" basis without any warranties of any kind, including the warranty of merchantability or fitness for a particular purpose. 8.1.1 Quality of Service: MewTropics does not guarantee the accuracy, reliability, availability, effectiveness, or timeliness of the services provided. 8.1.2 Third-Party Links: Any links to third-party websites are not under the control of MewTropics, and MewTropics is not responsible for their content or functions. 8.2 Acknowledgment by User: You acknowledge and agree that your use of the Services is at your sole risk.

9. Limitation of Liability

9.1 Limitation on Indirect Damages: In no event will MewTropics be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses. 9.1.1 Basis of the Bargain: The limitations of damages set forth above are fundamental elements of the basis of the bargain between MewTropics and you. 9.2 Damage Cap: MewTropics' total liability to you for any claim arising out of or relating to this Agreement or our Services will not exceed the amount you paid us for the Service that is the subject of the claim.

10. Amendments to this Agreement

10.1 Right to Amend: MewTropics reserves the right to unilaterally amend this Agreement at any time. 10.1.1 Notification of Amendments: There does not have to be any notifications, it is your responsibility as the customer to be up to date with the terms. 10.1.2 Acceptance of Amendments: Your continued use of the Services following the posting of any changes to the Agreement constitutes acceptance of those changes. 10.2 Review of Changes: It is your responsibility to periodically review this Agreement to stay informed of updates.

12. Miscellaneous

12.1 Entire Agreement: This Agreement constitutes the entire agreement between you and MewTropics regarding the use of the Services, superseding any prior agreements between you and MewTropics regarding the Services. 12.1.1 Amendments: No amendment or modification of this Agreement will be effective unless in writing and signed by MewTropics. 12.2 Severability: If any provision of this Agreement is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement will remain in full force and effect.

13. Termination

13.1 Termination by MewTropics: MewTropics reserves the right to terminate or suspend your access to and use of the Services, at our sole discretion, without notice and liability, for any reason, including breach of this Agreement. 13.1.1 Effect of Termination: Upon termination, your right to use the Services will immediately cease.
13.2 Termination by User: You may terminate this Agreement at any time by discontinuing the use of the Services and contacting MewTropics to deactivate your account.
13.3 The only customers exempt from this rule are official members of the Mewtropics Community. 13.3.1 Termination for members has to be for a reasonable cause. 13.3.2 Reasonable causes for member termination include bad attitude toward staff, bad-mouthing staff, and discouraging customers, and potential customers from becoming customers or members.

MEMBER'S RIGHTS AND PERKS:

14. Members' Perks Under Consultations

14.1 Once customers create an account and complete an online or in-person consultation, they are no longer just customers, but official members of the Mewtropics Community. This grants them perks that will improve the overall feel of the experience. 14.1.1 The customer must complete the consultation in its entirety to be able to become a member.
14.2 The perks that the member will have include and are not limited to access to the Mewtropics+ Discord Server with a discord role that will give you access to q-and-a sessions and useful information completely for free. The freedom of contacting the founder (G_hano) in personal discord direct messages, without limit (see section 15 for more details). 14.3 Staff members are responsible and have the obligation to share this section of the Terms to anyone who purchases a consultation, regardless of having completed it or not. 14.4 Members are exempt from SECTION 13 of the terms (see section 13.3 for more details).14.5 More updates and perks will be coming soon as Mewtropics grows as a company.

15. Messaging G_hano

15.1 Official members of the Mewtropics Community (see section 14), have the freedom to direct message G_hano the entire month following the date of their consultation without limits to the number of messages, regarding their progress, and any potential questions they may have. 15.1.1 Once the month of service ends, Members will need to purchase another consultation to avoid thousands of members messaging at once. 15.1.1.1 Specific Patreon or Phase 1.5 subscribers of the service are exempt from section 15.1.1 and do not have to complete another consultation to continue direct messages with G_hano 15.2 Members are not limited to ask questions solely about their progress, but can ask questions regarding the science in general.

16. Phase 1.5 terms

16.1 Prohibition on Sharing Content

16.1.1 As a subscriber, you acknowledge that all content provided within the Mewtropics library is for your personal, non-commercial use only. 16.1.2 You are strictly prohibited from sharing, distributing, or otherwise making available any content from the subscriber library to any third party, whether in whole or in part, without the express written consent of Mewtropics.

16.2 Penalties for Breach

16.2.1 If you are found to have violated the non-disclosure and non-distribution terms outlined in Section 16.1, Mewtropics reserves the right to terminate your subscription immediately. 16.2.2 In addition to termination of your subscription, you agree to compensate Mewtropics for any losses incurred as a result of the breach. 16.2.2.1 The base compensation amount will be up to $100, reflecting the potential impact of the unauthorized distribution on Mewtropics. 16.2.2.2 If the content is shared in a space with more than 1,000 members (e.g., forums, groups, or any online/offline communities), you agree to pay additional compensation up to $500, given the broader potential impact on Mewtropics. 16.2.2.3 Mewtropics reserves the right to charge these amounts directly to your account or pursue other legal remedies if necessary.

16.3 Trial mode

16.3.1 Phase 1.5 currently has a 3 month trial mode where users will be bound to the subscription for 3 months. 16.3.2 Canceling will be possible during this time, when We will attempt to reach the member for the reason of cancelation. 16.3.2.1 If no response is given after two contact attempts, the member will be restored of their subscription. 16.3.3 The reason for this term is to reduce the risks of content hoarding (where members will get the subscription, take all of the information, and cancel their subscription.

16.4 Acknowledgment and Agreement

16.4.1 By purchasing a subscription to the Mewtropics library, you acknowledge and agree to abide by the terms outlined in Section 16. 16.4.2 Your continued use of the Mewtropics services constitutes your agreement to these terms and conditions.
